In New Jersey, driving while intoxicated offenses are, without doubt, the most serious matters that are heard by the Municipal Courts. For a first offense, a driving while intoxicated conviction is punishable by a fine of no less than $250.00 and no more than $500.00, up to 30 days incarceration in the county jail, and a loss of driving privileges for no less than 3 months and no more than 1 year (together with other penalties). For a second offense, a driving while intoxicated conviction is punishable by a fine of no less than $500.00 and no more than $1,000.00, incarceration in the county jail for no less than 2 days and no more than 90 days, and a loss of driving privileges for 2 years (together with other penalties). For a third (or subsequent) offense, a driving while intoxicated conviction is punishable by a fine of $1,000.00, incarceration in the county jail for no less than 180 days and no more than 364 days, and a loss of driving privileges for 10 years (together with other penalties). These penalties can be enhanced (e.g. doubled) if the offense occurs on or within 1,000 feet of school property, whether or not children are present at the time of the offense.
